Vegetables are part of the plant, Fruits contain seeds. It gets a little more complicated then that, but that covers most of the bases.

Botanically it is a fruit, its actually a type of berry. However, according to the US Supreme Court it is considered a vegetable so it will be susceptible to vegetable import taxes.
